Legislative framework of gambling regulation

Overview

In Panama, the operation of gambling establishments is regulated by the Gaming Control Board (Board) as established by Decree Law No. 2 of February 10 of 1998 (Gambling Decree) (see Question 3). This law provides that the State of Panama can grant contracts, authorisations and gaming licences to third-party operators of casinos, slot machines parlours and any games that the Board determines to be games of chance. The Board also regulates the operation of hippodromes.
The operation of casinos and Type A slot machines (that is, slot machines that can only be offered in full casinos or in approved gambling halls (see Questions Question 2 and Question 4)) are regulated by the following laws:
  • Resolution No. 92 of 12 December 1997.
  • Resolutions No. 1 and No. 2 of 26 March 1998.
  • Resolution No. 83 of 19 August 1999.
  • Resolution No. 40 of 28 August 2003.
  • Resolution No. 4 of 19 January 2011.
  • Resolution No. 19 of 1 April 2011.
The operation of Type C slot machines (that is, slot machines that only allow a maximum bet of US$3 per stroke and a maximum payment of US$200) are regulated by the following laws:
  • Resolution No. 28 of 18 December 1995.
  • Resolution No. 42 of 21 January 1997.
  • Resolution No. 56 of 19 June 1997.
  • Resolution No. 39 of 28 August 2003.
  • Resolution No. 51 of 16 May 2012.
  • Resolution No. 97 of 17 October 2012.
The operation of bingo halls and bingo slot machines are regulated by the following laws:
  • Resolution No. 25 of 28 August 2003.
  • Resolution No. 59 of 22 September 2010.
  • Resolution No. 17 of 1 April 2011.
  • Resolution No. 38 of 19 July 2011.
The activity of televised bingo is regulated by Resolution No. 41 of 30 July 2010.
The operation of betting agencies on sporting events is regulated by the following laws:
  • Resolution No. 77 of 4 August 1999.
  • Resolution No. 25 of 1 April 2011.
Internet gambling is regulated by the following laws:
  • Resolution No. 65 of 25 October 2002 (Online Gambling Law)
  • Resolution No. 18 of 14 February 2003.
  • Resolution No. 10 of 23 June 2004.
The operation of racetracks is regulated by the following laws:
  • Resolutions No. 60 of 30 July 1999.
  • Resolution No. 6 of 11 January 1999.
  • Resolution No. 126 of 13 February 1998.
Massive audio text games are regulated by Resolution No. 82 of 19 August 1999.
